Not sent.
Recorded Sunday at 2:11 a.m.
We do not know why he recorded it.
Maybe he meant to send.
Maybe he rehearsed.
Shane’s voice:
“Ben, I’m going to fix this. You need to stop yelling when Mom is there. You’re making everything worse.”
Pause.
“I’ll get you out when the accounts are straight. I swear.”
Another pause.
“I didn’t mean for you to hit your head.”
Then:
“You’re my brother. I’m not going to let you die.”
The recording cut.
It destroyed the voluntary-hiding defense.
It also undercut a murder theory.
Shane knew Ben was confined.
Knew he was injured.
Knew he wanted out enough to yell.
Intended eventually to release him.
That is still kidnapping.
Still unlawful restraint.
Still evidence tampering.
